Terms of Hire
Terms and conditions for mobile coolroom hire services by Moana Hire

1. Acknowledgement of Terms
I, the undersigned, acknowledge that I am hiring a cool room (refrigerated storage unit) from Moana Hire, and agree to the terms and conditions outlined in this waiver.
By booking and hiring equipment from Moana Hire ("the Company"), you ("the Hirer") agree to be bound by these Terms of Hire. These terms constitute a legally binding agreement between you and Moana Hire.
2. Use of Equipment
I understand and agree that:
- The cool room is for storing temperature-sensitive goods only.
- I will not store prohibited, illegal, hazardous, flammable, or explosive materials.
- I am responsible for ensuring proper loading and unloading to allow airflow and avoid damage.
3. Condition of Equipment
I acknowledge:
- I have inspected (or had/will have the opportunity to inspect) the cool room and confirm it is in clean and working order.
- I will return it in the same condition, excluding normal wear and tear.
4. Risk and Release of Liability
I agree:
- I use the cool room entirely at my own risk.
- Moana Hire is not liable for loss, damage, or spoilage of contents, including due to mechanical failure, power outage, or human error.
- I release and hold harmless Moana Hire, its staff and contractors, from all liability except where caused by gross negligence or wilful misconduct.
5. Indemnity
I agree to indemnify Moana Hire against any claims, damages, or losses arising from:
- Misuse or improper storage
- Breach of this agreement
- Injury or property damage resulting from my use of the cool room
6. Insurance
I understand:
- Moana Hire does not provide insurance for items stored in the cool room.
- I am responsible for arranging appropriate insurance coverage for my goods.
7. Payment and Fees
I agree to:
- Pay all hire charges, deposits, and applicable fees.
- Cover the cost of cleaning, damage, or late return.
- Accept that additional charges may apply for misuse or excessive wear.
8. Key Access
If I am issued a key, I understand:
- I am responsible for the safekeeping of the key during the hire period.
- Lost keys will incur a replacement fee of $100 and/or rekeying costs.
- Keys must be returned immediately after the hire period ends.
- I will not duplicate, share, or lend the key without written permission from Moana Hire.
9. Power Backup
I understand:
- The cool room is connected to the primary power source and may not be equipped with a backup generator unless otherwise stated in writing.
- Moana Hire is not liable for power outages or resulting spoilage unless a written agreement for power backup services is included.
- It is my responsibility to monitor the power supply and take precautionary measures if needed (e.g., backup arrangements, temperature monitoring).
10. Termination
Moana Hire reserves the right to refuse, cancel, or terminate hire if:
- Terms of this agreement are breached
- The cool room is misused or damaged
- Unsafe or illegal items are stored
No refunds will be issued if termination is due to breach of terms.
Hire Period & Booking
Hire Period: Calculated from the agreed delivery date to the agreed collection date, inclusive of both days. There is no minimum hire period unless otherwise stipulated for specific equipment or promotions.
Booking Confirmation: Bookings are confirmed upon receipt of full payment and email confirmation from Moana Hire.
Availability: All bookings are subject to equipment availability. We operate with limited inventory.
Delivery Schedule: Delivery and collection times will be confirmed after booking and payment.
Payment Terms
Payment Required: Full payment is required at the time of booking.
Payment Methods: We accept all major credit and debit cards via secure Stripe payment processing.
GST: All prices include GST (Goods and Services Tax).
Currency: All prices are in Australian Dollars (AUD).
No Hidden Fees: The price quoted includes all fees except for additional services requested after booking.
Delivery & Collection
Delivery Area: Free delivery within Sydney and surrounding areas. Additional charges may apply for locations outside our standard delivery area.
Access Requirements: The Hirer must provide adequate access for delivery and collection vehicles. Additional charges may apply for difficult access locations.
Site Preparation: The Hirer is responsible for ensuring the delivery site is prepared, level, and suitable for equipment placement.
Failed Delivery: If delivery cannot be completed due to access issues or site conditions, additional charges may apply for return visits.
Cancellation & Refunds
Cancellation Policy: Please refer to our separate Refunds & Cancellations Policy for detailed terms.
Weather Conditions: Hire periods are not extended due to weather conditions unless equipment failure occurs.
Force Majeure: Moana Hire is not liable for delays or cancellations due to circumstances beyond our reasonable control.
Dispute Resolution
Communication: Any disputes should first be addressed by contacting Moana Hire directly.
Governing Law: These terms are governed by the laws of New South Wales, Australia.
Jurisdiction: Any legal proceedings will be subject to the jurisdiction of NSW courts.
